This page describes the ways in which the site safeguards the personal data from the users who consult it. This is information which is provided in compliance with Article 13 of the Italian Legislative Decree 196/2003 - a code concerning the protection of the personal data of those persons interacting with the web services of the site. The information is provided for the Phantom srl site only and does not apply to any other website which may be reached by the user through links. The information also takes inspiration from Recommendation no. 2/2001 which the European authorities for the protection of personal data, gathered as the Group instituted by Article 29 of Directive 95/46/EC, adopted on 17 May 2001 in order to identify certain minimum requirements for gathering personal data online and, in particular, the methods, times and nature of the information which the owners entitled to process such data must provide to the users when said users connect to web pages, whatever the purpose of the connection.

TYPES OF DATA PROCESSED

Navigation data
The IT systems and software procedures involved in the operation of this website acquire certain personal data during normal operation. The transmission of this data is implicit during the use of the internet communication protocols. This is information which is not gathered in order to be associated with identified interested parties but which, due to their nature, could allow users to be identified through processing and associations with data held by third parties. The IP addresses or domain names of the computers used by the users who connect to the site, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the dimension of the file obtained in reply, the numerical code indicating the status of the reply given by the server (successful, error, etc.) and other parameters relative to the operating system and the user’s IT environment fall into this category. This data is only used for the purpose of extracting anonymous statistical information regarding use of the site and to ensure its correct operation and is deleted immediately after processing. The data may be used to ascertain responsibility in the event of hypothetical data processing offences against the site: with the exception of this eventuality, data regarding web contact does not remain for more that seven days.

Data voluntarily provided by the customer
The optional, explicit and voluntary sending of electronic mail to the addresses given on this site results in the subsequent acquisition of the sender’s address, necessary in order to respond to the requests, in addition to any other personal data provided in the message. Specific summary information will be shown or displayed progressively on the pages of the site set aside for particular services on request.

Cookies
No personal data from users is purposely acquired from the site. No use of cookies is made for the transmission of information of a personal natural, nor are any so-called persistent cookies i.e. user tracing systems of any type, used. The use of so-called session cookies (which are not memorized in a persistent way on the user’s computer and disappear when the browser is closed) is strictly limited to the transmission of session identification data (composed of random numbers generated by the server) which is necessary in order to allow safe, efficient site exploration. The session cookies used on this site prevent the need to rely on other data processing techniques which could potentially jeopardize the confidentiality of user navigation and do not allow the acquisition of personal data identifying the user.


OPTIONAL NATURE OF DATA SUBMISSION

Apart from the navigation data, as specified previously, the user is free to provide the personal details indicated during contact with the company. As regards the information request form, the submission of data marked with an asterisk (*) is compulsory for the purposes of granting the service.
Its non-submission may lead to the impossibility to obtain the requested service.


PROCESSING METHODS

Personal data is processed with automated instruments for the time which is strictly necessary in order to fulfil the purposes for which the data has been gathered. Specific security measures are observed in order to prevent data loss, unlawful or incorrect data use and unauthorized access.


RIGHTS OF THE PARTIES CONCERNED

The party concerned by data processing may exercise the rights referred to in Article 7 of the Italian Legislative Decree 196/2003
The party concerned is entitled to obtain confirmation of whether personal data which regards it exists or not, even if the party has not registered yet, and the communication of this data in an intelligible form.

The party concerned is entitled to obtain information regarding:

  • the origin of the personal data;
  • the purposes of and methods used in processing;
  • the logic applied in the case of processing carried out with the aid of electronic instruments;
  • the essential identification data of the owner, persons in charge and the designated representative in accordance with Article 5 paragraph 2;
  • the subjects or categories of subjects which the personal data may be disclosed to or which may become aware of such data in the role of designated representative of the State, persons in charge of or responsible for such processes;

The party concerned is entitled to obtain:

  • updates , amendments or, where relevant, supplements to the data;
  • the deletion, transformation into anonymous form or blockage of data processed unlawfully, including data whose conservation is not necessary in relation to the purposes for which the data was gathered or subsequently processed;
  • the confirmation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of the persons with whom the data has been shared or to whom it has been disclosed, except in the event that this action is impossible or requires the use of means which are clearly disproportionate in relation to the right protected.

The party concerned is entitled to raise a total or partial objection:

  • for legitimate reasons to the processing of personal data regarding the party, even though such data is relevant to the purpose of its collection;
  • to the processing of personal data regarding the party for the purposes of sending advertising or direct sales material or for carrying out market research or business communication. Within our company, only the employees and collaborators (who may also be external) in charge of processing the data, belonging to structures which undertake technical and support tasks also on our behalf (in particular: legal, IT-related and delivery services) may become aware of the data. In addition, for administrative and accounting purposes, the data will be disclosed to credit institutions, professionals and consultants.
